涉外离婚的类型和离婚形式

　　涉外离婚分为一方是中国人而另外一方是外国人、双方都是中国人但是至少一方居住在国外的、双方都是外国人但是目前居住在中国、婚姻缔结地在中国、婚姻缔结地在外国、离婚时居住地在国内和国外等多种情况。除非是在中国缔结的婚姻且双方自愿离婚，可以在民政部门登记离婚，其余情况均需通过诉讼程序办理。特别是双方都是外国人的情况，即使双方自愿离婚，如果离婚时双方都在中国工作、居住，希望在中国办理离婚手续，也需要通过诉讼程序。

　　Foreign related divorce includes:One party is Chinese and another party is foreigner,both parties are Chinese but one/two party living abroad,both parties are foreigners and currently living in China,registered marriage in China or abroad,and residence in China or abroad when handling divorce.If both parties live in China and agree to divorce,they could sign a divorce agreement in Civil Affairs Department,but other circumstances shall divorce by litigation.For cases which both parties are foreigners living in China and they agreed to divorce,they shall still divorce by litigation.

　　中国法院的管辖Chinese Court Jurisdiction：

　　具体而言，能在中国法院提出离婚诉讼的情况包括以下：

　　1、双方都是中国人，在中国缔结的婚姻，但是一方定居在国外的，或双方定居在国外但是定居法院不受理的;

　　2、一方是外国人、一方是中国人，婚姻缔结地在国内的;

　　3、一方是外国人、一方是中国人，婚姻缔结地在国外的，但是离婚时被告居住在国内的;

　　4、双方都是外国人，离婚时居住在中国，且双方自愿离婚，愿意接受中国法院的管辖。

　　The following circumstances may bring a lawsuit in Chinese Jurisdiction

　　1/Both parties are Chinese,registered marriage in China,one or both parties living abroad,but the foreign court did not accept this case

　　2/One party is foreigner and another party is Chinese,registered marriage in China

　　3/One party is foreigner and another party is Chinese,registered marriage in abroad,but the defendant living in China when the lawsuit is brought.

　　4/Both parties are foreigners living in China,agreed to divorce and accept the Jurisdiction of Chinese court.

　　对离婚案件的正确期待 Expectations towards divorce

　　对于想尽快结束婚姻关系的一方来说，由于离婚案件的人身性，法院都会谨慎处理，给双方一个足够时间的冷静期，因此可能无法在时间上令该方满意。尽管离婚的时间点被拖后，在一方坚决离婚的情况下，最终也难以挽回离婚的结果。

　　The court will prudently handle divorce case because its personal nature and give each party sufficient time to cool down and reconsider,so the trial procedure is not time effective.If one party insist to divorce,he/she will finally get that judgement though time consuming.

　　外国法院判决的承认和执行 Apply recognition and enforcement of judgment of foreign court

　　外国当事人一方，拿到中国生效判决书后，法律程序还没有结束。如果需要中国法院的判决在其所属国有效，还需要在该过法院申请对中国法院判决的承认和执行。反之亦然。如果当事人是在外国法院获得的离婚判决，也不是自然在中国生效。比如在中国的一方需要再婚或者根据该判决对中国境内的财产进行执行分割，也需要首先在中国的法院申请承认和执行该外国法院判决。

　　After the foreign party obtained the effective judgment of Chinese court,he/she shall apply the court at his/her residence to recognize and enforce the judgement,thereafter he/she can marriage again and divide marriage community property,vice-versa.
